The Financial Times cites a team of MIT Business School professors to explain why “people tend to buy back and use record-keeping technology to protect themselves from being victims of criminal investigations. ” In addition to helping protect customers from being victimized by those who have tried to recover their information by others, such use of strong audit techniques could also have a negative effect on small businesses. “Many accounting firms are being asked to redact certain information from their own documents without specifically releasing them, which could have the unintended effect of shielding innocent citizens,” writes Daniel Peterson, editor-in-chief of The Wall Street Journal. Among the findings, Dr. Peterson says: “You can’t trust the [confidential] part of some type of record that shows that a company committed a crime and was fined.” In addition, two recent audit reports by the Office of Government Ethics concluded that corporate records fraud is not an inherent or general concern of the Securities and Exchange Commission Act (“Securities and Exchange Commission”) and of financial institutions in the United States. As the Inspector General for Securities Litigation (IGSE) found, “Sols may, at an appropriate time of year, issue documents during sales hours to record keeping companies and trade-affiliated groups, including by telephone, fax, (readers or anyone who is not recording records in their electronic databases), to or from consumers and businesses, and even to organizations the SEC considers critical to protecting our securities and exchange regulatory system.” Thus, certain recordkeeping practices can be known to breach the American economy’s very trustworthiness. And, according to testimony by Lisa Jackson, vice president of the U.S. Department of Congress Communications Program, the timing of these records request is sometimes crucial. “All of it depends on the store. Government doesn’t always have to go through all these procedures to do recordkeeping right now . . . the fact is the recordkeeping should be automated or at least monitored.” Kellogg says something similar about how the government targets “operators, business people, business entities, political parties and advocacy groups for abuse of proprietary information” and could use strong, high-tech data collection to better serve its interests sooner.
